Legal & Ownership
A freehold means the buyer owns the property and the land it stands on permanently. However, foreigners cannot own freehold land directly under Indonesian law, which is why leasehold and PT PMA structures are used instead.
A leasehold is a form of property ownership where a person buys the right to use a property for a fixed period of time, but does not own the land it is built on. It is the most common structure used by foreign investors in Indonesia.
At the end of the leasehold term, the contract can be renewed under new conditions agreed between the parties. In practice, Indonesian landowners have a strong incentive to renew, as the property improvements significantly increase the value of their land. We also work with lawyers who specialise in renewal and extension processes.
A PT PMA is a company registered in Indonesia that allows foreigners to legally own and run a business in the country. Through it, investors can operate, invest, and access certain property rights that would otherwise not be available to non-Indonesian nationals.

Yes. You can transfer your position depending on the contract structure. We can also assist in finding potential buyers within our investor network, making the exit process as straightforward as possible.
Income begins once the villa is operational and receiving guests. Rental profits are distributed monthly or quarterly directly to your bank account, wherever you are in the world. You receive full transparency reports with occupancy rates, income generated, and management fees deducted.
Taxes
In Indonesia, rental income is taxed under the final income tax (PPh Final) at 10% of gross income. In addition, when investing through a company (PT PMA), the company pays corporate tax, which starts at 11% on net profit for small companies. In Spain you must declare the income, but there is a double taxation treaty between Spain and Indonesia that prevents you from paying twice on the same income.
